Legal Question in Immigration Law in Nevada

I just recieved a letter from my attorney that he recieved information from uccis that the appeal has not been accepted with a return check. normally I have recieved information from uccis the same time that he has recieved it and at this point I have not recieved anything. My attorney states that now we have to submit a new DS-230 and a I-601. I feel that my attorney has not taken my case seriously and their for I have at this point going on 3 years without my husband , have lost our buisness, home and now find myself emotional stress out starting my life all over. I can't move to Mexico because we can't all depend on is parents to surport us, and I have my mother who is 86 years old who needs medical attention in the US. To relocate to Mexico at this time is inpossible for me. I have to try to support myself and send my husband money so he can not be a burden to his parents, who are barely making it these days. I can't afford an new attorney at this time and my attorney is requesting more money. I have already paid him 3,500.00 to handle my case. What can I do? Please help me.....Julia

Sorry to hear about this. What application was denied? You appealed what? I-130 or I-601?

If it was the I-601 which got denied, you can possibly reapply again by providing stronger waiver application. Please keep in mind that grant of a hardship waiver is always a discretionary relief (it means that it can be denied). You have to show that your hardship is exceptional and extreme.

Your situation looks like you may have a stong case for a Hardship Waiver (I-601). However, you may want to consult another attorney and get a second opinion about your case, legal options and chances for a waiver approval.

The legal fee that you paid is very reasonable in my opinion, some other lawyers can charge twice more for assistance with a waiver application alone.
