Legal Question in Immigration Law in Nevada
My wife and i got married in Feb 21, 2009. We went back to australia for 5 months because she got a working visa. While we were in Australia she got pregnant so now we are back in America so she can have the baby here. I am on the Visa Wavier Program and it is expired. Is there anything i can do to extend my Visa or get a Green card because she is due in less then 4 months and i would like to see my baby born. And if i tried to go to another country to Renew my Visa Wavier or if i try to return to Australia could i be kicked out of the America for 10 years?

You can't extend or renew your Visa Waiver program. However, if your wife is a USA citizen, you might be still able to apply for adjustment of status (Green Card) as a husband of a US citizen.
You should not file anything with the USCIS/DHS or leave the country without talking to an immigration attorney about your situation and options first.
How long ago did your I-94/Visa waiver expired?
