We have been living in the United States since 2000 but never filed income tax. We are now permanent resident (since July 2008).

By law, how far back (in years) do we have to go to file income tax with the IRS?

The Statute of Limitations on the Assessment and Collection of taxes does not BEGIN to run until a tax return is filed for a particular year. Therefore, the smartest move will be to file your Federal (and State) Income Tax Returns since you began living in the U.S.

Usually, these matters are not criminal. Nevertheless, in case your matter has criminal possibilities, you should hire a Tax LAWYER (not an accountant or tax preparer.) This will assure attorney-client priviledge.
