appearance required for probate

my fiancee' is in jail in fresno ca, relaease date of 6/18 to go into a 1 yr drug treatment program, his prob. officer will not agree to anything. thomas brother died in nevada and probate is on 6/24, does he have to appear? or have an atty. appear? can this be handled thru the mail? how?

He doesn't have to appear but he should have a lawy
