Legal Question in Health Care Law in New Hampshire

who legally must obtain a consent for a stress test

When a pt. signs a consent form for a stress test-who must instruct the pt. on the procedures and risks? MD?, Rn?, can it be a cardiac technician?

Re: who legally must obtain a consent for a stress test

The physician or his designee can do the instruction, but the duty rests with the physician to make sure that the patient has enough information about the procedure to make an informed decision to consent. Thus, if the technician does the instruction and fails to mention a significant chance of Arrhythmia or death, the patient has not been fully informed.

A physician should always ask a patient before beginning if they have had their questions answered and if they have any more.

Hope this helps.
