Legal Question in Bankruptcy in New Jersey
Reaffirmation on car lease
I filed and was discharged in 2001. The atty didn't get my re-affirmation to the auto company in time so the debt was discharged for my lease. I still have the car and am making payments. My question is when/if I decide wheather or not I want to keep it, can I just turn it in and not be responsible for overmileage charges etc? I am under the inpression that I can since the debt was discharged.

Re: Reaffirmation on car lease
The debt that was discharged in your bankruptcy was the dischargeable debt on the date of filing. Debt incurred after filing is debt which is NOT included in your bankruptcy and you must pay back. P.S.: I am assuming you filed a Chapter 7 bankruptcy.
