Legal Question in Business Law in New Jersey

When you have a contract to perform a Home Improvment for a consumer, they in turn cancel there contract day before your coming to perform and have done so in writting after permits were pulled. With them pressing a criminal theft by deception and was indicted on this can a motion be made since there was also a arbitration clause should there be any dispute? They are in breach of the contract for these reasons, 1. arbitration 2. access to work area on property 3. cancel contract if muctual agreed. There was no civl court that overturned the contract any advice?
