Legal Question in Business Law in New Jersey

Hello, I own a landscaping business in NJ and an employee quit last year. He opened his own business and threw flyers in the driveways in the same towns I work stating he was a former employee of my company and he started his own company.

Can he do this?

Unless you have a written non-compete agreement in place that will be considered reasonable in context by the NJ Court, then yes he can do whatever he wants.

My colleague is generally correct. However, even if there is no written non-compete agreement, if he is interfering with contractual relationships you have with your clients then there may be ways to remedy the matter. There may be other issues as well involving the misuse of your trade name.
