Legal Question in Business Law in New Jersey

nom-compete

i have no contract with my present firm for a no-compete clause-actually no contract at all- I have developed a client base over the years that have no long term contract with my present firm outside of a spcific 1 time contract for a single dedicated service the contract is specific and carried out and my firm is paid--I am presently leaving this employment and would like to continue a free trade relationship outside of this present company. I was told that I cannot contact any of this former client base since they are company assets, I told my employer that this is a free market and I had as much right to contact them after leaving as they had to continue to service them. I was the sole contact to these accounts and serviced them faithfully, am I legally bound to stay clear of these accounts ? and if so how long ?

Many of these cases turn on specific facts. It is not in your interest to discuss your situation in a public forum. I can tell you that you have a big advantage because you do not have a contract with a non-compete clause. Another thing to look for is a confidentiality clause. If you are leaving your current employer, be cautious about taking any physical property that belongs to your employer. Downstream, you may get into an argument over who owns the information in the customer list and whether you can use it jointly. That argument is easier for you if the list is on your paper or your flashdrive. There are also some other preventive measures that you need to take.

I have read the comments by John, and as usual, he is right on. You would need to give a full explanation, with all kinds of details that should not be put out onto a public computer bulletin board for everyone to see. Go sit down with a lawyer and get some solid advice.

If you would like, give me a call; I am in northern New Jersey. The telephone consultation will be free. I would be happy to help you out.
