Legal Question in Construction Law in New Jersey
small claims location
Can a New Jersey Elevator Contractor sue a defendant in Small Claims Court for breach of contract---i.e. non-payment of $1,000.00.
Our principal business address is in New Jersey---that is where the contract was sent from and to!
However, the company we performed the work for is located in Manhattan. The work was performed in Manhattan
We want to sue in NJ not NY.

The New York lawyer tells you that you have to sue in New York. I am a NJ lawyer, been doing collections for a couple decades, and it is not so simple. For small claims you must sue the defendant in the jurisdiction where it has an office. Therefore, you must sue the defendant in New York City (Manhattan).
