Legal Question in Construction Law in New Jersey

tree service

contracted with tree service to prune and fertilize trees April 5. Two page contract, one to prune one to fertilize.Crew comes with set appointment and says too big a job wants more money to trim trees. I feel they gave low ball price and are doing bait and switch and refuse. If they can't do the job for the agreed upon price then they lost the job. After all they have been in business over 20 years and know their pricing. July 28 come home and fertilizer treatment put down out of the blue. No notification and no appointment I can not verify that they just didnt spray my garden hose. $300 dollar bill due in 30 days before interest charges. Called office and no one has gotten back to me in 4 days . Is the contract still in effect when they walked away from the job in search of more money. Can they pick and choose which job they choose to do because it was 2 contracts? what steps do I need to do to protect my interests.

Re: tree service

No, they can not sign a contract to prune specific trees for a specific price then demand more money.

Fertilizer - not as clear.

They do not sound like they are going to talk to you and do the right thing.

Getting a lawyer involved will cost you a bit of money, but may get some results.

and if this is something that they have done before, 'bait and switch', then they could be in BIG trouble. consumer fraud, triple damages plus attorney's fees.

Please call my office if I can assist you. You can then decide how you would like to proceed.
