My brother has been the victim of identity theft and to make matters worse the person who did this to him is our father. This has been going on for several years now. When we first found out we contacted the three credit reporting agencies to put a fraud alert on his account. My brother has also been contacting the credit card companies and auto dealers to clear this up. HOwever, it has not been easy. I have calculated over $125,000 placed in his name fraudulently that we know of. When we confronted my father, he admitted to only a ''little'' and told my brother to file bankruptcy because it would be easier for my brother to file than my father who is too old To make matters worse my father died a year ago and my brother is having an even more difficult time clearing his name. I have looked at documents and it is so blatent I can't believe it is so difficult to prove He has also filed apolice report met with a county prosecutor and an attorney who recently told him since my father is dead he is now responsible. My father's wife is still alive, and we believe she had a part in it. What can be done most importantly to clear this up. He can't even refinance or sell his condo because of all the liens (thanks dad) Please advise

Your brother needs a lawyer.
And whatever lawyer told him that because his father died, now the debts that your father fraudulently created are now the responsibility of your brother is wrong. I can not believe any attorney would say that.
If your father used the fraudulently obtained money to buy things, your brother may be able to sue and get those things. That will not make your stepmother happy. Too bad, do it anyway.
This will not be easy. But it has to be done.
