how long does a collection agency have to sue on a bail forfeiture and what if the defendent was incarcerated at the time of court date?

How long is going to be several years, so that is not likely to help you.
On the other hand....if the defendant was locked up at the time he was supposed to be in a courtroom, that may be a way to get this resolved.
