Legal Question in Credit and Debt Law in New Jersey
my stepson owes an attorney$1500 for past representation (10/07). My stepson has not paid anythng since 7/08 and the attorney is saying my husband executed a retainer agreement setting forth his presonal responsiblitliy for any amount due to him. Is my husband responsibel to pay his sons debt. His son is over 21. The attorney is threatening to begin legal proceedings against my husband.

If your husband signed a personal guarantee agreeing to pay if his son does not, then I would think that your husband would be responsible. think about it, if you signed something saying that you are personally responsible for someone else's debt, don't you think you should live up to what you said you would?
Keep in mind that this advice is given based on the little bit of information that you have
provided in your question. My advice may change based on other information. Further, no one
can rely on advice from an attorney who has not been retained. You cannot rely on this advice because we have not personally met and you have not retained me as an attorney. If you have any questions whatsoever, you should meet with an attorney for a full consultation before you take any further steps. Good luck! Rob Gleaner
