Most people assume they can't afford a lawyer without really looking into it. You are facing felony charges and I suggest you make some calls to really see what you can and cannot afford. Call me anytime at 732/773/2768 to discuss further.

I know it stinks, but you are probably going to need to "hire" the services of the public defender. In New Jersey, many municipalities charge a small fee for this service which is based on your income. What municipality do you have to go to for this?

An alternative to the public defender is to ask a lawyer to do it for low fee or no fee (pro bono). My office regularly takes on cases under those circumstances.

You do have some cause for concern given that the retail value of the items was greater than $200.00. Here is the applicable portion of the statute:

Shoplifting is a crime of the fourth degree if the full retail

value of the merchandise was at least $200.00 but does

not exceed $500.00. N.J.S.A. 2C:20-11c(3). A crime of

the fourth degree is punishable by a term of imprisonment

not to exceed 18 months (N.J.S.A. 2C:43-6a(4)), a fine

not to exceed $10,000 or both (N.J.S.A. 2C:43-3b(2)).

If you have any questions, feel free to write back at [email protected].

Although you are looking at some serious penalties, there may be a variety of ways to minimize, or maybe even eliminate, the charge against you. I have handled many cases like yours throughout New Jersey in the past, and continue to do so. Please contact me to discuss your case in more detail. I never charge for simply talking to a person about their case. Thank you.
