Legal Question in Criminal Law in New Jersey
I got caught shoplifting and I was taken to the mall jail and was talked to and everything and then an officer came arrested me (didn't read me my rights) and took me to the "mall jail" if you wanna call it that. Where he fingerprinted me and took my mug shot. I was told that my Miranda rights didn't have to be read because it was in the mall so when I court I plead guilty because I knew I was and there was no point fighting it when I was on camera and whatnot. However, I went to a criminal justice seminar and was told that my Miranda rights should have been read to me, is that right and is there anything I can do about it now? The fine and community service isn't a problem but if I can get this off of my record because my Miranda rights were not read to me I will precede to fight it. Should my Miranda rights have been read since I was arrested or no because of the setting and I wasn't actually taken to jail?
