my son is really supposed to be out on bail but he was picked up for violating probation on a charge that happened last year he is incarcerated in union cty jail for about 7 weeks already shouldn't he still be out on bail until this case goes to court?

A violation of probation is a separate charge based upon misconduct after a conviction of a crime. Bail is possible but not mandatory. You need to hire the right lawyer.

He would only be out on bail if somebody paid his bail. Even when he gets out on bail he still has to face the charges against him. Unless his charge is extremely serious, bail has probably been set. However, it may be too high for him or for you to post. Bail is supposed to make sure he shows up for court, not keep him in jail until his trial.
