Legal Question in Criminal Law in New Jersey

Expunging one's record

In December of 1998 I was arrested for shoplifting. I recieved a fine and have since paid it off. Is it possible to wipe my record or clean now or is there a period of waiting? Please advise on how if this can be accomplished and when.

Expunging one's record

Assuming the one shoplifting is all you have ever been charged with, you can have the conviction expunged after five years. The five years begins to run upon completion of payment of the fine, or completion of probation (if any was imposed), whichever comes last.

Re: Expunging one's record

As with any legal question my answer is a general one. I would need to review the speific facts of your case in order to give you a more complete answer. For that reason, this response does not constitute legal advice and I am not becoming your lawyer by answering.

Now, with that out of the way, the basic answer is that if you were convicted of a disorderly persons offense, which is what shoplifting usually is, that you may not have your record expunged for 5 years, provided that you have not been in more trouble. This answer assumes that you were convicted or pleaded to the state crime of shoplifting, a.k.a. disorderly persons.

If you are in South Jersey and would like the case reviewed further and would like me to check into your case specifically as to whether you may have the record expunged now, then please contact me at (856)616-8080 or e-mail at [email protected].

Thanks,

Daniel B. Kelley
