to find out if i can be chared with an excape after 2 years

I excaped from a min.sercurity fasilaty in 2004 i got cought the same day and finished my time and was released in 2005.and now it's been elleven months i have been home and i get a letter in the mail i was woundering if they can do that would't that be due prassees

The statute of limitations for a third degree offense is five years. I believe that your escape

charge is a third degree offense. I say "believe" because I do not have a copy of the

criminal charge made against you.

Mr. Moore is correct because I just looked at this statute for another client today. Escape is 3rd degree and the SoL is 5 years. I suggest you get a good attorney to work on this. He or she needs to make the State realize that its not the right thing to do, even if they can legally do it. There may be some due process type arguments available, but I would need more information.
