Legal Question in Criminal Law in New Jersey
possession of stolen goods
I was charged 13 years ago with possession of stolen goods. The circumstances of the arrest where that I was a passenger inside of a parked van on a retail store parking lot. There were four of us in all. One of the other passengers went into the store and was arrested for shoplifting. The police soon surrounded the van and arrested us. I had no idea that these people were shoplifters. The police found stolen property in the van, but no stolen property on me. How can I defend myself in this criminal case?

Charged 13 years ago? If you are only now in court and facing charges and trial on this, as a result of being arrested on a warrant issued 13 years ago, then evidence will be tough for both sides, and you have some defenses. The charges would have to have been filed many years ago; the prosecutor can't file now for the first time on you; the statute of limitations would be expired. If this is in SoCal courts, and if you're serious about getting legal counsel to defend you, feel free to contact me. There are a lot of issues to discuss before being able to provide any opinion.

13 years ago??? If you never dealt with it, it sounds like the facts you mentioned would be very favorable to you. On those facts, you are not guilty of anything. Seek the advise of a qualified attorney. David Wallin
Re: possession of stolen goods
Your question is a little confusing. This was 13 years ago? If you never dealt with it, there sould be a warrant for your arrest. Call me at 732/247/3340 to discuss.
Re: possession of stolen goods
There is a warrant out for your arrest, most likely. Hire a local New Jersey lawyer to look into it.

Re: possession of stolen goods
Your story leaves a lot of questions unanswered. It may be that there is no valid basis for the charges against you, or it may be that you have responsibility based on conspiracy or constructive possession. And, of course, there is the issue of the 13 year gap. You really need to speak with a NJ attorney. Call me if you would like to discuss it further at 877*688*3879.

www.njworkerscompensationlaw.comll move to dismiss the charge for coming ot court so many years later. If it is a more recent case, I would need to review the evidence to see if there is any way to beat the case.
