Reducing a Felony to a misdemeanor NJ
I have a eluding charge in 2005 is there anyway I could petition the court to have the charges reduced to a misdemeanor?

There are no felonies and misdemeanors in NJ. Felonies are called crimes and misd. are called disorderly persons offenses. If you are charged with a crime, you could sometimes get the prosecutor reduce it to a DP - in some cases. If you have questions, call me.

You have not provided enough information but usually there is room to negotiate (depending on the facts). You should consult with counsel to review your options.

If you were already convicted of the eluding charge, then the answer is NO. If the case is still pending, then there is a possibility that you can reduce the charge by way of a plea bargain. If you have nay further questions please give me a call. Thank you.

If you have a pending charge it is a matter of getting the prosecutor's cooperation or winning the case. If you have a conviction, the nature of the charge will not change.
