Legal Question in Criminal Law in New Jersey
Statutory Rape
16 year old is pregnant. She was 15 years old when she became pregnant. Father of the child is 18 years old. Parents of the pregnant daughter are divorced. Can the non-custodial parent file statutory rape charges against the 18 year old father even though the custodial parent (legal guardian) doesn't not want to? We live in the State of New Jersey.

you should probably contact the county prosecutor's office in the county where the young
lady resides, with your concerns. the state of new jersey brings the charges against a defendant in superior court, not a parent or guardian.
