Legal Question in Criminal Law in New Jersey
theft by deception
being charged with theft by deception in the amount of 170,000, has been indicted on the matter, had 5 status conferences with no plea offers to date. In the last status conference the judge was not speaking in terms of allegations, he was stating that I stole the monies not alledging I stole the money repeatly (can a judge make that open state in court during status conference phase), and my public defender did not challenge that statement. So 0 the prosecutor and the judge went back and forth in stating that ''He stole the money and/or paid his bills, so why are we in the fifth status conference''. This inappropriate conduct by the judge and my public defender's lack of defense prompted me to seek council elsewhere. I truly need help.

I generally don't have anything bad to say about Public Defenders, who usually try hard and unfortunately just have too much work to handle, but in this case it sounds really BAD.
There is an old adage, and that is you usually get what you paid for (and in this case you didn't pay much for the services of the PD), but just hiring any private counsel may not assure you good representation. Choose wisely...I have more than 15 years experience in PA and NJ and a can say that I will work hard on your case. I consider (and my clients agree) that my fees are reasonable. You need to hire an attorney; order transcripts of the judge's statements and file a motion with the court for the judge to recuse himself from the case. I am your man.

In order to qualify for a PD, you must not have that much money which worries me. How will you pay for a lawyer? Don't assume that any private attorney will be better than your PD.
