Legal Question in Criminal Law in New Jersey
theft and under influence
my niece is 20 years old and she was arrested for shop lifting and under the influence. this is hr second offense. now she was origionally arrested for shop lifting and as she was sitting with the officers her cell was a constent ring with her boyfriend saying pick up the phone which wasin her purse the officers emptyed her her and added posesion and under the influence . will she half to do jail time and does she needa lawyer or will a public defender be okay. and her previous offense is already done and over with and everything she had to do wasalrady completed.

She can get a jail sentence for a second offense.
If you think she needs only a lawyer who thinks of her case only when he sees her in court, a public defender is fine. Otherwise, an experienced attorney should be hired to protect her from harm.
