Legal Question in Criminal Law in New Jersey

wrong summons ?

" My fiancee was issued 2 summons for driving with a suspended NJ driver's license and being unlicensed. He's never had a NJ license but only a NY license and he doesn't ever recall ever having his license suspended. According to the DMV there is somebody in NJ with his exact first and last name, same height and eyecolor, and same birth month and year. Please help me! He's being accused for something he didn't do. I was advised to seek a lawyer but why should I have to spend all this money for something he never did? What's the proper way to go about this terrible situation?"

I hate to say this, but the rules are designed to make things easy for the state, while supposedly being fair to citizens. Generally speaking, unless there is rather compelling evidence on your side of the arguement, I wouldn't let anyone go into court without a lawyer. Depending where you live, you are looking at $300-500 for an attorney for a municipal court appearance.

If you want to save some money, you might try appearing, speaking with the prosecutor, and seeing if you can convince him to look into this matter further, to see if he can justify dropping the charges against you boyfriend.
