Legal Question in DUI Law in New Jersey
My 19 year old friend from New Jersey just got busted last night for DUI (of prescription pills if that matters), and also got a ticket for having unopened beer in the car, and reckless driving. What are the penalties hes facing for this?

Proving dui on alcohol is often a slam dunk for the prosecutor, but proving dui based on being under the influence of a drug is more difficult because it is not enough to prove that the defendant ingested a drug; the state must prove, beyond a reasonable doubt, that the defendant was under the influence of the drug to the extent that his ability to drive was impaired.
The proofs for dui on a drug is that a police office certifed to be a drug recognition expert examines the defendant and concludes that he was under the influence of the drug. The state's problem is that the police expert is NOT a physician and often can not state other reasons for the way the the defendant appeared, such as a migraine headache.
As a first offender the 19 years old faces the loss of his driving privileges for 90 days and various fines, if he is found guilty.

Your issues are very complex and I would not suggest that your friend go to court without an attorney. While I agree with the previous answer pleas bargaining may be involved here to reduce the charge. Call me and set up an appointment.
The penalties are very severe, including high fines, loss of driving privileges, possible jail time, possible community service, and five points on his license for the Reckless Driving ticket.
