Legal Question in DUI Law in New Jersey

DUI... N.J and PA

I live in PA and got a ticket for DWI in NJ. I also was ticketed for open containers and failure to maintain a lane. My main question is: if I live in PA and plead guilty to DWI in NJ, will I lose my driving priviledge in PA? If I do plead guilty the prosecutor will dismiss the other tickets, however; I own a small business that requires me to drive in PA and can't lose license! Also, does PA allow a drive to work license? If so, I can plead guilty. Please advise.

Better get a lawyer. PA and NJ have reciprocity. A plea to DWI in NJ will cause PA to revoke you for a YEAR. I don't know what the status of a work license in PA is.

There is a possibility of losing your license in PA - Lets see if we can defend the NJ DWI charge. There are alot of factors review to see if there is any way to have the charges dismissed or down graded. No one can tell you this until you retain a lawyer and I find out what evidence they have against you.

FYI - if your are found guilty or plead guilty note the following NJ penalties:

Violation of N.J.S.A. 39:4-50 (Driving While Intoxicated/Driving Under the Influence of Alcohol) is a serious charge which must be seriously defended. A guilty plea or a finding of guilt includes serious penalties including but not limited to - First offense is a $250.00 - $400.00 fine, 12-48 hours in a detainment center and at the Court�s discretion, not more than thirty (30) days in jail and a six (6) month to one year suspension of your driver�s license. For a second offense, it is a $500.00 to $1,000.00 fine, thirty (30) days community service and 48 hours to 90 days in jail, and a two (2) year loss of license. If you have a third offense, it is 180 days in jail, and ten (10) year driver�s license suspension. In addition to the basic penalties, there are additional fines including a drunk driving enforcement penalty of $100.00, a safe neighborhood penalty of $75.00 and surcharges which could amount through DMV of $1,000.00 a year for three (3) years.

If your license is suspended in NJ, then it will also be suspended in PA. I don't know whether or not PA has any form of restricted license for driving to work only, so you should check with your local DMV to see if such a license exists. However, there may always be a chance that you won't get convicted of DWI. I would have to review the evidence to see if it is sufficient for a conviction. Obviously, there is a danger that if you plead guilty to DWI in NJ, PA authorities might well suspend or revoke your license to drive. The NJ prosecutor has no control over what PA will do, so cannot make any promises to you one way or the other as to what PA will do once they are notified of the NJ conviction.

Even if you might be eligible for a conditional license in PA, you have no basis to think that you will be given one by PA authorities.

(As only one issue, you don't indicate what your prior driving history is.)

You are facing a serious criminal charge which, if you are convicted of (or plead guilty to) it, could well result in your inability to earn a living. As such, a proper defense is worth many, many, thousands of dollars. Don't be penny-wise and pound foolish...you need to retain an attorney immediately to defend you against the NJ charges.
