DUI in NJ
Subject and 2 friends were asked to leave local bar for loud & rowdy behavior, subject was observed getting behind the wheel by the Bouncer. He pulled into another bar down the block, & spent 5-10 min inside. When he came out, officers were checking out vehicle, & asked if the car was his (but NOT if he had been driving). When he said 'yes', he was arrested on DUI and car was impounded. Officers never saw him behind the wheel -- this all happened on the say-so of the security person at the first bar. Did the Officer act appropriately, or does the subject have a case for getting the charges dropped?

The officers assumed that the car was driven there by the owner and therefore acknowledging ownership meant acknowledging operation to the
officers. Of course operation must be proven beyond a reasonable doubt.

That's why we have trials. The bouncer would need to come to court and testify. I suggest you get a good attorney ASAP.
