Legal Question in Elder Law in New Jersey
Taking Advantage of Elderly Parent
My mother-in-law's daughter and husband live with her. Initially the reason they lived with her is that they overextended themselves on loans and lost their own home. They have continued to live with her for many years moving their adult children in with them. My mother-in-law's home was paid off and the family has just learned that the daughter and her husband borrowed money on the home and it went into foreclosure. No one is sure if the deed was signed over to the daughter and her husband or if it was when it took place. I believe as far back as ten years ago my mother-in-law was diagnosed in the early stages of Alzheimer's. This had been her home for over 50 years. Is there anything the family (her sons) can do?

Re: Taking Advantage of Elderly Parent
There's no easy answer here, other than that you need to have the situation reviewed in detail with an experienced attorney to see what the documentation looks like, and what the facts actually show. Your options are to resolve it or bring a lawsuit if appropriate, including a Petition for Conservatorship if necessary. Feel free to contact me if serious about doing this, if the case is in SoCAL area.
