Child Custody

I have joint custody of my 13 yr old daughter. What are my rights if I want to move out of State?

Thank you for your inquiry. You cannot leave the state of New Jersey with the minor child unless you have a Court Order permitting you to do so. In order to obtain such an Order, a motion needs to be filed on your behalf.

If you seek to move with your daughter, you will have to have the consent of your former spouse or permission from the Court. If you have a true joint custody situation, you will be seeking a change in custody. If you do not have a true joint custody situation, but you have primary residential custody, you will be seeking to relocate with the child which requires a showing of good faith for the move and that it is not contrary to the best interests of the child.
