Child Custody
I have joint custody of my 13 yr old daughter. What are my rights if I want to move out of State?

Re: Child Custody
Thank you for your inquiry. You cannot leave the state of New Jersey with the minor child unless you have a Court Order permitting you to do so. In order to obtain such an Order, a motion needs to be filed on your behalf.
As it would be my pleasure to speak to you regarding your situation, please feel free to contact my office at 732 246 0909 to discuss same.
Very truly yours,

Re: Child Custody
If you seek to move with your daughter, you will have to have the consent of your former spouse or permission from the Court. If you have a true joint custody situation, you will be seeking a change in custody. If you do not have a true joint custody situation, but you have primary residential custody, you will be seeking to relocate with the child which requires a showing of good faith for the move and that it is not contrary to the best interests of the child. Either way, you are probably looking at a full hearing on the issue. If you would like to schedule a consultation to further discuss this, please contact my secretary, Debbie at 856-795-6700.
