Child Custody

How to I successfully obtain sole custody of my two children (9y.o. & 4.y.o) who have had no contact with their father since 2006. He calls to harrass me but does not ask to speak with the kids. He lives wiith his mother 1 hour away. He is a functional aloholic.

You file a motion with the court. Obtaining sole custody isn't easy, especially by yourself. However, it sounds like you certainly have merit to your motion. I have an office in Toms River so call me at 732/247/3340 to discuss.

Apparently, you and the father of your children are not married. Assuming this is the case and that there is no existing custody order, I would suggest that you file a custody complaint with Family Part of the Superior Court of New Jersey, in the county where you reside with the children. From what you say I conclude that you may win by default when he does not appear in court.
