Child support included in College support obligation
My son who is eighteen will be attending a 4 year college this fall. Both myself and his mother have a 50% commitment to his 4 year college expenses per our divorce agreement. We both share custody of our son with his mother as the primary residence and I pay child support. The divorce decree does not stipulate how long child support will continue. Since my sons primary residence during the year will be at his college and both parties have agreeded to share 50% of those costs while include food, living accomodations etc., can I calculate my support payments in my 50% contribution to is college costs? If I am paying 50% plus child support, I effectively pay more then 50% and my former wife less then 50%.

Once your child is attending college the child support obligation is only for those periods that he is at home and thereby receiving support. This does not mean that the support payments are made during only those times. It means that the amount of support is reduced.
