would the courts do this
My son is almost six. His father has not been in his life at all up until last year and even that was sporadic. We went to NY and filed for paternity in 2006. At that time I was awarded sole custody. His father did not apply for custody or even visitation. He has now applied in NJ for custody of my son. Would the courts award custody to a virtual stranger

You should hire a lawyer in the County where the lawsuit was filed.

Courts do strange things and whatever will happen, will happen. I'm not sure what my opinion will do for you. Regardless, my guess is no, of course no, but if he wants to be in the child's life, the court will set something up to accomplish this.

You need to consult directly with an attorney. There is a question raised by the brief amount of facts in your posting as to whether a NJ Court even has jurisdiction other than as a referral to GA where you now seem to live. While his chances at sole custody seem very small, never assume what a Judge might do.
