Legal Question in Family Law in New Jersey
I was divorced in June of 2010. We both equally hold a property which we agreed I would live in and take over mortgage payments and maintenance on until January 2015, when either I would buy out her half or the property would be listed. I am not in financial position to buy out her end. My question is: if she forces me to sell, would she then become responsible for half the mortgage from when it lists until it sells? Her only interest in the property is financial, and she is now remarried, living in another state, and has not resided here for four (4) years.

This should be directed to your divorce attorney. Either that or you need to hire an attorney to review everything. It sounds like a real mess and why I don't allow my clients to do things like this. Call me at 732/773/2768 to discuss.
