Legal Question in Family Law in New Jersey
Enforcement of a final order
When a judge renders his decision in a support matter and directs one of the attorneys to prepare the order and submit it to him, when does the order take effect? In particular the judge gives his decision on Sept. 28 and directs defense council to prepare the order. This goes back and forth between the attorneys and on Dec 6 the judge signs the plaintiffs version of the order. On Dec 16 the judge's office faxes a copy of the signed order to the plaintiffs attorney who then provides a copy to the client. When was this order to be followed by the parties?

Re: Enforcement of a final order
The Order is effective on the date that the Judge issued his/her decision from the bench. Actually, I have seen cases where the parties could never agree on the form of the Order and so one of the attorneys just ordered the transcript of what the Judge said on the bench and that became the Order. I hope this helps you. Good luck!
