ex-husband is above the law
Ihave been in a battle with my ex-husband over money for 7years. He uses our children now 15 and 13 as pawns. He is a police officer in N.Y. and ever since I got remarried he has made my life a living hell. So much that it is causing problems in my marriage. For tjhe past 4years he has not seen the children. He also has not paid any medical or dental bills.As a result I am being sued by the doctors. He also has been trying to claim the children on taxes which is causing a great deal of hardship.I finally took him to court for the medical bills and an increase in child support.He in tern turned the table around and told the judge that I do not let him see the children and then told the judge that I owe him alimony. Now the judge ordered an investigation of the home as well as to the alimony. As to the increase in child support the judge denied it because of some imputed income. I told the judge that I have a sick child at home that requires a nurse to take care of her.That is why I am not working. The children are upset and fear that there sports and other school activities will be compromised.He also has the tendency to call and play love songs to me. I took a restraining order out. How can I prove he is not above the law.

It sounds as though you have some litigation ahead of you and you should consult with an attorney and hire an attorney.
As for the harassing phone calls. This is very surprising because harassment is an act of domestic violence. Harassment is a criminal act constituted by a course of alarming conduct or of repeatedly committed acts with purpose to alaarm or seriously annoy such other person.
Your former husband is a policeman and should know that a domestic violence restsraining order will prevent him from carrying a firearm. I am amazed that he has been attempting to annoy you in any way.
You can go to the county court house domestic violence offense and file a domestic violence complaint. I just reread you question and you seem to have a restraining order already. If that is the case you can file a criminal complaint against him for violating the restraining order. This is a very serious matter because, assuming that your restraining order is filed in New Jersey his violating the order is not a petty offense but a third degree crime punishable by up to five years in prison.

You need an attorney. No, he is not above the law, and harassment will come back to cause him problems, if you pursue it. You clearly need a decent divorce attorney, so let me know if you would like to speak to me.
