Legal Question in Family Law in New Jersey

Ex-partner not allowing my kids to go back home with my parents while I finish my nursing school. He told me he rather take them in, while I go pursue my nursing degree. And after I finish, which is after a year I can take them back. However, I'm worried that he might try to take custody of them, taking me to court, etc.

He might. Or perhaps your kids might rather stay with him anyway. Even now, depending on how long you were together and the relationship he developed with the kids, he may still have some parenting time/visitation rights. Perhaps you should enter into an agreement with him right now to avoid all of those issues later.

Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, you may want to contact a Family Law attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. If you call me at 856-546-8010, mention Law Guru and your first one hour consultation will be free. Good luck! Rob Gleaner
