Legal Question in Family Law in New Jersey
My fiances ex wife has filed motion number 4 on him...another frivolous motion. He sent a counter motion like he always does. He received the "answer" from the judge today via fax and one thing it said was that he needs to fill out a form granting her the.right to get passports on their kids. He's totally angry because the motion that he received said NOTHING about passports. So because he didn't address it in his crossmotion, the.judge automaticall granted it to her. My question is...if she intentionally left out paperwork when she sent his copy of the motion to him and sent.a different set of paper work to the courts...is that illegal?

The failure to provide a complete copy of the moving papers to the opposing party is a ground for vacating the Order that was granted upon a motion for reconsideration, which must be filed within twenty days of the receipt of the Order.
