Legal Question in Family Law in New Jersey

My husband and I have been separated since 9/09 and still working out details of divorce. Support/custody/alimony already ruled upon. I would like to buy a home within the next 3 months to get the children into a better school district. If the divorce is not final, and I purchase a home, can he try to claim it as a marital asset?

It depends on the source of the funds and whether a divorce complaint has been filed signaling the factual end of your marriage. You should ask you attorney and get some sort of waiver to any claim to the house BEFORE YOU SIGN A CONTRACT FOR SALE OF REAL ESTATE.

Hasa property sett,ement agreement been signed . I would suggest having a divorce complaint filed to cut off any equitable distribution issues. PLease call my office and set up an appointment.
