can my husband's ex stepfather be granted visitation in NJ?

My husband's mother divorced her husband (my husband's stepfather) about 2 years ago. Now he wants visitation with my daughter, 4 1/2, and my son, 17 months, who was born after they divorced. Can an ex-step-grandparent be granted visitation in NJ?

Based on the facts you set forth, it appears unlikely that there would be any legal basis for the step-grandparent's application should he go to Court. Of course if you and your husband agree to let him see the children then you certainly may do so. Good luck.

Grandparent(s) do have a very limited right of visitation in New Jersey. However, it is the grandparent's burden to prove that without the visitation the grand-child will suffer some harm.

Based on the limited facts of your question, it does not appear they would have any legal basis to obtain visitation. However, if they file a action in court, I would recommend that you hire an attorney to assist you.
