Legal Question in Family Law in New Jersey
I have married my wife in Cairo, Egypt, back in 1989 according to the Islamic law, the marriage contract states clearly that the marriage is controlled by the rules of that law which states clearly that this contract can not be revoked by non-moslims and only Islamic Shariah Law is the only reference when it comes to divorce.
I migrated to USA in 1996 and took my wife and four kids (they were born in England) with me as I was given a green card as a scientist who reached to the highest level in his field of practice, and later a became a US citizen.
Due to internal family issues, my wife has decided to file for divorce in USA; once I was informed of such action, I filed immediately a counter law suit against her in Egypt which gave me the right to bring her back to Egypt and not to accept any orders of divorce by non-Islamic courts, issued in any other country.
I field my case by myself in Cairo, Egypt, before she obtained any court orders from the sate of new jersey where we resided in USA.
While I was outside USA, she got a court order of the filed divorce, the custody of my kids and the ownership of my house, and access to my money left in my business and personal bank accounts, back in Nov. 2006.
On the other hand I got a court order from the Egyptian family court stating clearly that the USA divorce is not accepted by Islamic Law that is Originated the marriage contract between the two parties and the marriage is still valid !.
As she prevented me from talking to my kids, and send them any money whatsoever, despite my several attempts to get my kids individual bank information so that I can deposit the money directly to their bank accounts (my kids are now 20,19,18, and 17).
I have checked my public records and found that there is an arrest order out there for me for not paying child alimony (that I am more than willing to pay providing that I can get back to USA safely, and restart my engineering business).
I do not want to play Russian Roulette by coming back to USA and get arrested for a crime I did not intentionally commit. As If I am to get arrested at the Airport, I would not be able to restart my Engineering Business and pay back my Alimony dues.
Please, I need a professional legal advice as what is the best route to use.
Yours,
Dr. Eng. Sharif S.M., Ph.D., P.E.(NY)
