A mess of a mess

My mother fraudulently obtained custody of my son. When I found out I filed to have the motion vacated as she lied in court and I was never served. AFTER I filed against her my son's father filed for custody of my son. He has never met my son and does not have custody. We established paternity in NY in 2007 and I was awarded sole custody of my son. What I want to know is what is his chances of getting custody of a child he does not know and has never met.
