Moving to another state

If I have residential/full custody of my daughter and the mother has not made any contact for 6 years do I have to notify her if I am moving out of state? Also if I have residential/full custody in New Jersey do I also have this custody if I move out of state?

You should first check the custody order to determine if it addresses this issue. It may require you to notify the court if you plan to move out of state (even though you have sole residential custody, you may techincally have joint legal custody) Defintely notify the other parent that you are moving out of state. If the otehr parent does not consent you should file a motion for permission to move out of state.

If she has visitation rights under a judgement or order or separation agreement, she is entitled to notice that you are leaving the state. If she objects you will have to obtain an order from a court authorizing your move. I would think that you would advise her by certified mail that you intend to move as of a certain date and that if you do not hear from her by a certain date before you plan to move you will be moving to wherever you are moving. 800 273 7933 is my office number.
