Legal Question in Family Law in New Jersey

Substitution of attorney

I have a motion pending in family court, and want to terminate my attorney as I can not afford her fees. No decision has yet been made on the motion. What is the process for doing that? Can I file a motion pro se, or myst the attorney do so? Thank you.

Re: Substitution of attorney

There is really no motion to file. It is a form. You could call the attorney and ask her to draft it for you. Be sure to ask if you will be billed for it. As a courtesy, I don't think you should be, but that is just me.
