forging signature on auto contract

Hi,

My wife's fater bought or leased the car that he drives, later my wife discovered (by the letter sent by the financial institution) that she is on the contract. We think that she is under contract as a co-signee. The problem is that my wife never signed contract. As far as I know her father asked her for a copy of a driver license to take care other business so she give that to her father but never signed anything.

I would like to know what do we have to do this to remove my wife from the contract. Do we have to confront the dealer who made possible without my wife's knowledge or her father and the dealer both? Do we have to sue them?

The dealer had cheated on our previous auto contract that there were $2000 rebate when buying the car but mis-informed us and later got that back by fighting several week on that.

Please send us an advise what action is the best for this kind of case.

You have not mention the manufacturer of the car. With most Japanese car manufacturers they will take the dealer's skin off if he misbehaves. In any event, we are talking about financing and there is always the federal government agency which has oversight or the state's banking department for filing a complaint against the dealer/manufacturer.

By the way, forgery is a crime. You could file a criminal complaint againsgt the dealership and let them deal with that.

You have some options. The dealership will resist efforts to remove her, and you will need to push quite hard.

A threatening letter from a lawyer might do it; if not, you can contact NJ Consumer Affairs Division to see if they will assist. Other options may take a lawyer's assistance.
