Special Civil Court

1-What is the time limit in filing a claim from the date of the incident?

2-I was unfairly fired, and I have a written and oral contract for monies owed that were not paid. I have also filed with the EEOC, who says I have a case of age and religous discrimination. I was also ging to file a parallel special civil case for the money owed.

Are these two seperate actions, or does the eeoc ruling have any bearing on the special civil case?

If you file a separate action for the money, you risk losing your civil rights claim. That is because New Jersey has what is known as the "entire controversy doctrine" which requires that all related causes of action be brought in the same suit if possible.

If the EEOC has issued a finding that you have been the subject of religious discrimination, it remains to be seen what the employer is going to do about that. Your cause of action for money damages would ordinarily be good for six years from the date that it accrued.

You should consult with a lawyer to help you. That is particulaly true here because many civil rights actions require that the offending party pay attorney fees also. You may be able to get the assistance of a lawyer at no cost to you in the long run. Check that out.
