Legal Question in Immigration Law in New Jersey

if a baby is born in the United States but its parents are illegal is that baby a usa citizen and would that baby have problems with immigration later on?

Yes, a baby born in USA is American citizen. However, this doesn't affect his/her parents' illegal status. Most likely, the baby can also derive second citizenship through his parents' citizenship.

However, please note that a child who is born in the US is automatically a US citizen even if their parents are illegal.

If the parents have not become legal by the time the child reaches the age of 21 then the child can, as a US citizen, file a petition on behalf of their parents.
