Legal Question in Immigration Law in New Jersey
H1B to F1 and Back
Hello
I was on an F1 status from Dec 2001 to July 2004. My OPT started on Aug2st 2004 and My H1 started on Aug2 2005. Now I plan to go back to school to pursue an MBA starting Fall 2009. My question is will I subject to quota, when my employer( of 2011) files for my H1 B?
Also can you send any relevant links on USCIS.gov? My search on that site yield nothing.

Seems that you won't be subject to quota but just from the fact pattern might be better if you have an immigration attorney guiding you along the way. There is no way to say definitively what will be the state of affairs in 2011.
