Legal Question in Immigration Law in New Jersey

H1-B Visa Extension

My H1B visa expires in Oct 2010 for its 6 year limit. My current employer has filed an extension and is approved for next 3 years based on the fact that my I-140 for Green Card application is been filed and approved. Also its been 6 months my I-140 is approved.

My question is, if I change my employer rightnow, will I be able to maintain my extended visa period? Also, will I be able to maintain the I-140 which is approved for more than 6 months?

Re: H1-B Visa Extension

I would need more information regarding your particular case before I can comment on it properly.

However, if you immediately change your employer they will have to file for an H1-B transfer which would take a while. In addition, your new employer would have to provide all the documentation that your original employer gave to the immigration service.

With regards to your I-140, that will also be at issue.
