Legal Question in Immigration Law in New Jersey
Hi,my H1B extension denied on Dec 10 2009 (completed 3 years), my I-797 and I-94 got expired in sept 2009. Tried filing for a new h1b however the cap count is over now. Can you please suggest the other options which i have other than filing for MTR.
Can I re-file the extension with pp ?
Can someone reply ASAP.....

You need to consult your lawyer (who assisted with H1B extension) and establish the reasons why the extension was denied, what is the problem?

I would additional more information regarding your particular case before I could comment on it properly.
However, what I can say is that as you know each year has a cap and once it is reached your only other option is to file for MTR or try re-filing for the extension.
You did not state in your e-mail the grounds on which you were denied, why?
